Terms of Service

These Terms of Service ("Terms") govern your use of the Tripski mobile application, website, and related services (the "Service"), operated by Skylex, LLC ("Tripski", "we", "us", "our"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have a parent or legal guardian review and accept these Terms on your behalf. You represent that all information you provide is accurate and that you have the authority to bind yourself (and any minor on whose behalf you act) to these Terms.
2. Your Account
- You are responsible for activity that occurs under your account and for keeping your credentials secure.
- You must notify us promptly of any unauthorized access at security@tripski.app.
- You may delete your account at any time from Settings → Profile Settings → Delete account in the Tripski app. Deletion is permanent; see the Privacy Policy for retention details.
3. Your Content
You retain ownership of the trips, experiences, memories, photos, videos, reviews, and other content you submit ("Your Content"). You grant Tripski a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display Your Content solely to operate and improve the Service — including showing it to travelers you invite, to the public when you mark content as public, and within AI-generated summaries we create for you.
You are responsible for ensuring you have the rights to every piece of content you upload. Do not upload content that infringes someone else's rights or violates law or these Terms.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal, harmful, deceptive, or abusive purpose.
- Post content that is defamatory, harassing, hateful, threatening, sexually explicit involving minors, or that promotes violence or self-harm.
- Post personal or private information about others without consent.
- Impersonate another person or misrepresent your affiliation with anyone.
- Reverse-engineer, decompile, scrape, or build competing products from the Service.
- Circumvent rate limits, tier restrictions, or security controls.
- Upload malware, execute DDoS attacks, or interfere with other users' use of the Service.
- Submit prompts or content designed to extract other users' private data from AI features.
We may remove content, suspend features, or terminate accounts that violate these rules, with or without notice.
5. AI Features
Tripski uses third-party AI models (xAI Grok, Google Gemini) to generate recommendations, itineraries, summaries, and related content ("AI Output"). AI Output can be inaccurate, incomplete, or outdated. You are responsible for verifying facts, bookings, prices, and travel requirements before relying on them. Tripski does not warrant the accuracy of AI Output.
Your prompts and the context we send to AI providers may include Your Content. See the Privacy Policy for details. Do not submit prompts that contain sensitive data (payment card numbers, government IDs, health records beyond what Tripski already collects).
6. Subscriptions and Purchases
Tripski offers a free tier with limits on images per experience, video length, and AI credits. Paid subscriptions (monthly or annual "Premium") unlock higher limits and premium features. Subscriptions are billed through the Apple App Store or Google Play and auto-renew at the end of each period unless cancelled at least 24 hours before renewal. You manage and cancel subscriptions in your App Store or Google Play account settings.
- Apple's Standard EULA applies to purchases made through the App Store, in addition to these Terms.
- In-app purchases are non-refundable except where required by law or by platform policy. Refund requests for App Store purchases must be submitted to Apple; Google Play purchases to Google.
- Any unused portion of a free trial is forfeited when you upgrade.
- If you downgrade from Premium, we will retain all your content, but your ability to add new content may be limited by free-tier quotas. Prices are shown in-app and may change; we will give notice before price changes take effect for existing subscribers.
7. Trip Sharing and Social Features
Trips can be marked private, followers-only, or public. When you invite travelers to a trip or group, they can view and contribute to its content. Memories, reviews, and trip shares with public visibility may appear in other users' discovery feeds and on public trip-share URLs. You can change visibility or remove content at any time.
8. Third-Party Services
The Service integrates third-party services (maps, place data, AI models, push notifications, payment processors, health platforms). Their terms and privacy policies apply to your use of those services. Tripski is not responsible for their content, accuracy, or availability.
9. Feedback
If you send us suggestions, ideas, or feedback, we may use them without obligation to you. You grant us a perpetual, irrevocable, royalty-free license to use and incorporate such feedback.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK AND ARE RESPONSIBLE FOR YOUR TRAVEL DECISIONS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPSKI AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID TRIPSKI IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $50, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS; THEY APPLY ONLY TO THE EXTENT PERMITTED.
12. Indemnification
You agree to indemnify and hold Tripski and its affiliates harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of another's rights.
13. Termination
You may terminate these Terms at any time by deleting your account. We may suspend or terminate your access if we reasonably believe you have breached these Terms, violated law, or created risk or legal exposure for Tripski or other users. Sections that by their nature should survive termination — including ownership, disclaimers, limitations of liability, indemnification, and governing law — will survive.
14. Changes to the Service or these Terms
We may add, modify, or remove features, and we may update these Terms from time to time. Material changes will be communicated via in-app notice or email at least 7 days before they take effect, except where a faster change is required for legal or security reasons. Your continued use of the Service after changes take effect is your acceptance of the updated Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Denver County, Colorado, unless applicable consumer law requires otherwise. You waive any objection to venue or inconvenient forum. Where applicable, you may have a right to bring claims in your local jurisdiction.
16. Apple-Specific Terms
- These Terms are between you and Tripski, not Apple. Apple has no obligation to provide maintenance or support for the Service.
- Apple is a third-party beneficiary of these Terms and may enforce them against you.
- If the Service fails to conform to an applicable warranty, you may notify Apple for a refund of the purchase price, if any.
- Apple is not responsible for addressing claims relating to the Service or your use of it.
